Proposal on opening access rights for passenger services on European railways
Abstract
This proposal opens up access rights for the provision of international passenger services, including cabotage, by the 1st January 2010 at the latest.
From this date, there will no longer be an obligation to form an "international grouping" in order to benefit from infrastructure access rights.
These access rights may be restricted in the case of routes which are the subject of a public service contract. However, this restriction may only be applied where it can be shown that this is necessary to maintain the economic equilibrium of the public service contract.
